With the rise of vaping, more people are now wondering “is e-juice FDA regulated and safe to consume”? Here’s what you need to know.
What Vape Products Does the FDA Regulate?
The health and safety-conscious among us will be glad to know that the FDA regulates e-juice and all related systems, including the following:
- A glass or plastic vial container of e-liquid
- Certain batteries
- Cartomizers and clearomizers
- Digital display or lights to adjust settings
- Tank systems
- Drip tips
- Flavorings for ENDS (electronic nicotine delivery systems)
- Programmable software
Since 2016, the FDA has been regulating tobacco vape products with the help of the Center for Tobacco Products. These rules are intended to help make their use as safe as possible for those who choose to consume it. CBD-containing e-liquids have been in a legal gray area for the past few years, but soon, we will probably see official FDA regulations on these products.
How Does the FDA Regulate E-Liquid?
First of all, the FDA separates vape juice and related products into two categories: those that are marketed for therapeutic purposes and those that are marketed for recreational use. The FDA regulates therapeutic and medical vape products through the Center for Drug Evaluation and Research. Recreational vape products are the responsibility of the Center for Tobacco Products.
The FDA (along with the CDER and the CTP) regulates vape products from beginning to end— or in other words, from the manufacturing process to the point when products hit store shelves. Here are some of the requirements that manufacturers and distributors must take into account when selling vape products in the United States.
The FDA lists specific requirements for all tobacco product manufacturers, and nicotine-containing e-liquids must comply with fees, registrations, ingredient submissions, and more.
When tobacco products are imported to the US, they need to follow the FDA’s rules for import. They must comply with all tobacco manufacturing requirements and must submit paperwork and contact information to ensure legality.
E-Liquid Packaging and Labeling
Packages for most e-liquids must be child-resistant to make it difficult for children to ingest dangerous amounts. In addition, anything that contains tobacco or nicotine needs to have a warning statement on its packaging and all advertisements.
Advertising and Promoting
As stated before, advertisements need to have nicotine warning statements in all advertisements. There are also limits on where tobacco advertisements can be located.
Sales and Distribution
Any store that sells tobacco-containing products needs to follow certain federal rules. There are also strict rules for vape shops that mix or modify e-liquids.
So, whether your favorite e-juice comes in a bottle or in a cartridge, you can rest assured that vape products are regulated much like foods, beverages, and pharmaceuticals.
Of course, this is only true for e-liquids that are produced in the US or legally imported. If you choose to vape, check containers for warning labels and other signs of compliance. If you purchase from reputable companies, you can stay as safe as possible while vaping.
